Terms & Conditions (“Terms”)

INTERPRETATION

Company means Katies Elite cleaning (us, we, our).

Cleaner(s) means person(s) or firm carrying out cleaning Services on behalf of the Company.

Client means the person, firm or corporate body together with any subsidiary or associated company as defined by the Companies Act 1993 to whom the Services are supplied by the Company (you).

Premises means the property or properties at which we provide our Services.

Services means the Services described in Schedule One or as otherwise agreed with you in writing from time to time.

Service Charges means the charges for the provision of Services as detailed in the Schedule One or as otherwise agreed with you in writing.

Terms means this document together with any other Terms and conditions that may be provided to you in writing.

PROVISION OF SERVICES

1. We shall provide Services and a quote for the services. You agree to pay the quoted price. In the event of a last minute service or one we are unable to see prior to commencement we will not charge less than $52.50 an hour unless otherwise agreed via text or e mail.

2. We may subcontract the performance of the Services or any other obligation under these Terms.

PAYMENT PROCESS

3. We will invoice you on completion of the Services in accordance with the quote provided.

4. Payment can be paid either via cash or directly into the bank account we will provide on the invoice presented to you on completion of the service.

5. We will provide the details for payment with the quote.

6. You are required to make payment within 7 days of the Services being completed unless otherwise agreed. Failure to make payment on time shall be a breach of these Terms.

7a. In the event of default of payment, the Company is entitled to charge interest at a rate of 2.5% per month of the outstanding balance until payment is made.

7b. Any and all charges incurred in recovery of any debt are chargeable and if sent to a debt recovery agent a minimum fee associated with that debt of $300 is added to the invoice.

7c. Using our service is to accept the terms of service unless otherwise notified to us in writing 24 hours prior to the work being undertaken.

CANCELLATION

Your right to cancellation:

8. If you wish to cancel our Services, you must provide at least 48 hours’ notice. If it is within 48 hours, we are entitled not to refund you.

9. We reserve the right to charge a 50% fee of the Services for cancellation if we are unable to rebook that time slot

Our right to cancellation:

10. We reserve the right to cancel or decline on reasonable grounds any order for Services without notice.

11. if unexpected circumstances occur that are out of our control we may cancel the Agreement without notice.

12. If you breach any obligation under these terms and fail to remedy the obligation within 5 working days of receiving notice specifying the breach, we may cancel the Services through written notice.

CLEANING SUPPLIES AND EQUIPMENT

13. All cleaning products and equipment required to complete the Services will be at the discretion of the Company and provided by the Company.

14. If you require certain products or equipment to be used, you will cover all additional costs.

15. You agree to allow us reasonable access to running water and electricity to carry out the Services.

VARIATIONS

16. If you wish to vary the Terms agreed upon originally, you must use the Schedule Two form. This form is required to be agreed upon in writing by both parties.

HEALTH AND SAFETY

17. You agree to provide a safe working environment for the Cleaners through the following:

Identifying fragile items and communicating this to our Cleaners or customer service team in advance;

Accounting for and securing all valuables;

Notifying us of any pets and, if necessary, placing them in designated enclosures that will not threaten our staff or impede our Services;

Removing any biohazards including, but not limited to, human bodily fluids, animal waste, and sharp bio products such as needles; and

Not requiring or requesting the lifting or moving of heavy objects.

18. If you do not comply with this clause, we will direct our staff to leave the location and our right to cancellation under clause 11 will apply.

LIMITATION OF LIABILITY

19. The Consumer Guarantees Act 1993, the Fair Trading Act 1986 and other statutes may imply warranties or conditions or impose obligations on the Company which cannot by law (or which can only to a limited extent by law) be excluded or modified. In respect of any such implied warranties, conditions or Terms imposed on the Company, the Company’s liability shall, where it is allowed, be excluded or if not able to be excluded only apply to the minimum extent required by the relevant statute.

20. If you are a business or a person in trade, you hereby agree that the Consumer Guarantees Act 1993 will not apply.

21. We will not be liable for any direct or indirect or damage including, without limitation, economic loss, loss of profit or savings, damage or destruction arising out of or in connection with the supply of Services including:

Unavailability of electricity and water;

Interference by a third party;

Inability to access the Premises for any reason outside of our control;

delays or termination of the Services due to any circumstances outside our control including COVID19 restrictions or any other national or regional emergency; or

Incorrect or insufficient information supplied by you or your failure to comply with our instructions.

22. Our liability in respect of any claim of loss, damage or injury resulting from a breach of these Terms is limited to the lesser of:

a resupply of the Services;

payment of the reasonable cost of supplying the Services; or

the price of the affected Services.

23. All claims of loss under this clause must be made in writing to us no later than 48 hours after the date you become aware of the circumstances giving rise to the claim.

INSURANCE

24. We will hold public liability insurance to the value of $5,000,000.

25. You are responsible for obtaining adequate insurance for loss to the Premises and your contents.

COMPLAINTS

26. If you are unhappy with Services provided by us, please phone us directly within 24 hours of receiving the Service.

27. We will endeavor to remedy the issue.

28. We reserve our right to determine this on a case by case basis in our complete discretion.

PRIVACY

29. We collect personal information from you, including information about your; name, contact information, location, billing or purchase information.

30. We will take all reasonable measures to ensure that your private information is well protected in accordance with our obligations under the Privacy Act 2020.

31. You have the right to ask for a copy of any personal information we hold about you, and to ask for it to be corrected if you think it is wrong. If you’d like to ask for a copy of your information, or to have it corrected, please contact us.

SERVICE

32. Please note we always text the night before (around 6pm) a service to give you a time frame for said service and in the event you do not receive this please contact us directly to ensure nothing has gone wrong.
